I don't see the problem. We can all run emunand 10.5 atm so therefore you can go online. hmm
Anyway, last i checked they can't FORCE you to do anything including update. YOU HAVE TO PHYSICALLY ACCEPT THE UPDATE YOURSELF!

Prior to today/the maintenance, you only needed the latest firmware to go on the eShop/Miiverse/etc.. As long you had the latest game update, you could play online all you wanted. Now it matches the Wii U where you need the latest firmware (or a frankenfirmware with whatever they're checking) to do anything related to Nintendo online stuff.
