Hacking GW/Sky vs CFW - Ban "Safeness"

Everyone already knows there's ALWAYS a risk. What I'm wondering is using GW/Sky actually a good amount "safer" than installing CIAs on CFW when using a private header vs. a CIA in which all Nintendo would have to do is check your eShop account?

CIA is always safer. It doesn't use any header which removes the ability to be banned by using same header on multiple units simultaneously.

This is true. That being said, i havent been banned and i've been using the same private header on my GW .3ds roms for more than a year. All of my games have the same one.

It seems like Nintendo hasn't done anything against CIA or private headers. This does however not validate that they don't have the ability to ban us, they just haven't done it yet.

I would say the opposite. Pirated content is less safe, you have illegitimate tickets on your system when you install pirated cias.
With GW/Sky3DS, your system actually thinks you are playing the game and there is nothing with bad signatures.
If you have stuff like devmenu and other homebrew cias on your system, that also could be a big indicator to Nintendo.

Anyway, Nintendo is gentle to pirating it seems so we don't have to worry about anything :)

What about sending a console with CFW to repair to nintendo? Do you think they can detect the CFW even if its emunand and the sd is not there?

That would be like sending a pc to a repair shop and have it seized because you have installed an iso file mount system (which cames with the system in win 10) and you don't have any iso file in the system.

no they are not if you use public headers they will fork ya in the donkey m80 i have been system banned for almost a month now

the hacked system is on the sd card. on the actual nand/3ds, there won't be anything. at worst there will be illegitimate tickets if you installed pirated cias on sysnand.

Hm. I'd assume they could find that updates/downgrades were applied with a program/system that's not their own.

I spose that eases my mind a bit. My system shipped out the same day they received it.

I find it quite accurate as any cfw what in fact does aside of disabling signature checks is mounting sd partition as firm to boot. Maybe are you refering to the execution permissions on locked software? For me, I payed both for my pc and for my nintendo's so for me as a professional coder is just natural that I can develop some piece of code and run it on the machine. That shouldn't be illegal imho. If you are a full commited pirate from the seven seas and use the unlocked software to grab your gold and give nothing back I think it's your fault/problem and I don't see a problem for that being illegal. So I find the analogy pretty accurate.

nintendo makes the 3ds, it's their choice to repair it, if they think you broke their rules then they don't have to touch it. if i send my laptop to some repair shop in the city, they don't care what is on it.
if my windows is pirated but my dell screen is broken, dell will still fix it, even if there is no os on it.

Sure, they can run his right to not touch it. But they can't charge you for doing anything or seize your system. They can in fact return it as is for ethical reasons, but there's no law enforcement going in there (given that you don't have even a single bit of copyrighted material not legitimate owned) and you can't (shouldn't) try to force them to repair it aswell to be respectful. You just go to another repair shop down the street and have it fixed, or just grab a new system and do the same.
