As 3DS and 3DS XL are no longer produced, if you find a new one, I'm pretty sure it will be on less than 9.2.
As for the 2DS, all bundles until now will probably be on less than 9.2, but I think the Yo-Kai Watch one will be on 9.9 or more.

Just update to 10.2 so no mo piracy
Says the one who have 4 Sky3DS and 3 exploitable 3DS with RXTools installed :P

It will *probably* be on 9.2 or lower, since afaik there hasn't been any restocks in a while. I'm really not sure though, but since it's only sold in bundles now (at least here in Europe), they probably aren't producing the standalone ones (so exploitable firmware).

I know, but what I meant is that even they are no longer produced, there isn't a lot of demand, so it's still really easy to obtain :P

The "old" ones only. When I got my ambassador edition, it was on 9.0 (and I updated it, I didn't know about CFW and stuff like that at the time, I want to punch my old self so badly) , and approximatively anyone that has been produced before april should be fine... But since it's a little hard to find right now, you can most likely find it either on small / not specialised shops that doesn't sell much consoles, or on the Amazon Marketplace / eBay.

If you buy a 2DS, I'm practically sure you're safe.
For the N3DS, it's a bit more risky. If it's a nice and friendly store, you can ask them to see the firmware version (you can do that for the 2DS btw, just to be sure, we never know :P ) by using the "I want to use the kernel exploit to run my emulators properly" excuse, if they ask you why.
In any case, since you're in the UE, you should be able to get a refund if you return the console within 14 days (if it doesn't have any visible signs of use, of course), so if you *really* take care of it while checking the FW version, that shouldn't really be a problem =)

Lol, they don't even know about the exploit here! :P But they don't let me open the packages and returns are a bit difficult ...

Oh, that's a problem...
If the place you want to buy the console from has an online website, buy it here, since all purchases made by Internet can be returned (no exceptions) within 14 days, because some European Union Law said so :P
If you can just buy it in store, I would personally go for the 2DS, or try to find an N3DS online.
Actually, I just had the idea, but you can also ask them for the serial (on the side of the box) and search what firmware version the 3DS comes with =)

Old 3DS/3DS XL models (as long as they are sealed and not opened) are guaranteed to be on firmware 9.2 or lower. The one I purchased recently actually had V2 of the firmware :-)

New 3DS/XL models however is a bit of a gamble. There are stores here in the UK which sell unboxed versions and I guess you can try out the device before purchasing to make sure

Can cfw be used out of the box on 8.1? Or would I have to get a game to update to a better firmware or something?

Would love to, but AFAIK there is no SN numbers guide for small N3DSes here.

So is it random whether it ships with a browser or not?
So you still aren't really safe buying one like that. Because afaik there isnt a way to give it a browser. You'd update with a game card but it doesnt update the browser. How would you do it then? What would be the point of buying a 8.1 2DS if it doesn't have the browser?
