Hardware What FW can I expect to have if I bought a (New) OldN3DS From an official resaler? (Gamestop)

I need a new 3ds. Preferably an Old N3DS from an official place such as Gamestop, Walmart, etc.? What should I expect to see FW wise on the new console? I need at least 8.9 or lower. I'm running an exploit of my own and I can't seem to run it on anything higher on FW. I also received a Gateway from a friend and it would be sweet to be able to use it, as it was expensive from where she bought it from. Note: Please be 100% sure about the info you post as I'm low on funds and cannot afford to spend money for nothing. I do however have enough money to buy any 3ds. Thanks in advanced.

I think any new (still in the box) O3DS will be 9.2 or below. So there isn't much to worry about. That's what has been reported so far anyway.

I don't know what is your exploit. In any case, Gateway works from 4.1 to 9.2 so it should be fine.

It supports emunand up to 9.5 on New3DS.

Sysnand is 4.x-9.2

Gateway supports sysnand (real system) up to 9.2, just like all the CFWs as well. 9.2 is the highest exploitable firmware for now. << what matters to you
It does however have emunand support up to the latest firmware (10.1) on O3DS and up to 9.5 on N3DS.

As for the firmware that the consoles will have, like I said, all the reports point to "still-in-the-box" O3DS still being 9.2 or below.

Highest firmware reported for a new o3ds is 8.1

Although buying used might be a better idea since you can inspect the 3ds and actually look at the firmware version. Not to mention its cheaper

Everything mentioned already is true, but keep in mind some people have reported getting an old 3DS above 9.2, these were most likely refurbished/returned consoles that were updated and then sold as new. That isn't likely to happen to you, but if it does then I would complain saying the console you got was not new.

Oh, you already got the console, in that case:
There's no risk in installing anything as long as you are on emuNAND since it's a copy of your NAND that's stored on the SD card, nothing on the system itself is touched.
I would recommend installing themehax so that you can get a cold boot CFW.

That guide will work, but if it's too hard to follow, follow this guide instead:

Once you are done with that step, you can install themehax and update your rxTools to the latest nightly, which is simple if you already have rxTools installed.
You don't need cold boot CFW, but it greatly simplifies things and makes CFW completely hassle-free once installed.

I don't quite remember seeing the option to install to EmuNand or SysNand, but I'll take you know what you're talking about as, no one can be more stupid than I am when it comes to technology. Second, no chance of brick or slim? And where are these games stored? On the micro SD in my GW or my regular SD card?

If you use the CIA manager in emunand, you'll install it in emunand. If you do it in sysnand, it will install in sysnand.
You should also unlink sysnand from emunand before installing anything too to avoid the gift unwrap bug.

They're stored in the SD card of the console. They're bound to the console. Think of the console as a PC and the SD card as a hard drive. PC programs get installed in the hard drive and CIA files get installed in the SD card just the same. You can't move them around. You can only install and uninstall.

And if you just mess with the basic (which I assume it will be all you'll do), you'll be fine. Especially if you only do it in emunand. So don't worry about bricks. But make backups of the NAND just the same anyway.
