If you were to sell off your console & buy a New Old 3ds, it'll be on <9.2 firmware.
You could also hunt for a N3DS using the Firmware by Serial Number guide. Though it'd be a bit more expensive.

Best way to not update is to never accept and start the update if you let the DS download it by leaving the wifi on while the lid is closed.

*In standby mode* That's only if you don't want the update nag. Even then, you can get rid of it by turning off the 3DS > L + R + Up + A while turning the system back on > Enter the update menu & select no.
It'll restart your system with the update nag removed; until you leave the wifi on in standby mode again.
