According to Nintendo themselves:
But more importantly,
Isn't it possible that the very same local wireless connection signals for local wireless multiplay are actually the streetpass signals? And if that's so, wouldn't it be possible for us to use the Streetpass Relays to spoof local wireless play over the internet, specifically, maybe using something like "Nintendo_3DS_continuous_scan_000", I understand that Streetpass Relays only allow individual 3DS to connect every 8 hours, but theoretically, there should be a way to bypass that limitation, and one of the easiest way would possibly be something to do with "Nintendo_3DS_continuous_scan_000"? (My understanding might be a bit off, if so, I would appreciate some corrections)?
The system cannot access the Internet unless you take active steps to connect to it. However, the system does come pre-installed with other wireless communication features such as StreetPass, which allows you to wirelessly exchange data with other systems within range.
But more importantly,
Wireless Communication - With the system’s wireless capabilities, you can communicate with up to 15 other systems within range of your system. This feature can be used by different games and applications to share data between users, such as sharing photos with the Nintendo 3DS Camera application, or to play multiplayer games over a local wireless connection.
