So, I posted a picture of the screen with ironhax as the savefile names to miiverse, and then on miiverse I saw a spotpass notofication. I can understand them taking this post down, but CRIMINAL ACTIVITY???
What in that post is illegal?
crime

n.
1. An act committed in violation of law where the consequence of conviction by a court is punishment, especially where the punishment is a serious one such as imprisonment.
2. Unlawful activity: statistics relating to violent crime.
3. A serious offense, especially one in violation of morality.

Perhaps it could be the third one, but I don't think that homebrew is morally incorrect to anyone??

You could for one time not be an asshole and stop bragging about the hack on every social media outlet there is. Of course Nintendo will delete all posts containing anything about it and they can chosse any reason they want.
I understand that, but why the fuck would they claim that they removed it for CRIMINAL INTEREST?!

It's possibly violating one of those EULAs you agreed to when using your 3DS. Why did you post about homebrew to Miiverse, run by Nintendo that is trying to secure its system from homebrew?

I believe if you were to mention Project M or PM (which is confusing since it could mean anything), you would also get an automatic warning for criminal activity. There's probably no other fitting generic message.

Nintendo tends to lump exploits and homebrew together with piracy. Piracy is illegal, homebrew and exploits are only against the EULA. Either way, Miiverse is theirs, so they have the right to take down whatever they want. Just wish they'd give a legitimate reason instead of a false one.

Hacking is actually illegal, so you posted content related to criminal activity (according to Nintendo - they interpret forum rules)
Read the dmca provision a:
https://www.law.cornell.edu/uscode/text/17/1201

This doesn't mean they are going to sue him or prosecute him, but they are within their rights to strictly interpret the law and apply it to forum rules for your post. Hell, they can ban you because your avatar is pink if they wanted to.

because they expressly forbid it on the box, in the manual, and in eula's.

not to mention modifying encrypted code and something I forgot while typing this sentence.

You must be really young. Nobody cares that you have an exploit on your 3DS. I can guarantee you that there are about a million Indian or Vietnamese people that don't care. You don't have to make things worse and bring Nintendo to open their eyes to what's happening ( but they probably are already aware)

Anyway, the reason your post was illegal is because Nintendo forbids such posts about their devices in their terms and conditions. This would be a major violation of that.

The warnings aren't custom, they're just dished out based on what category it fits closest. I doubt there is a category for "Being such a huge dumbass that you posted a picture of a modded savegame used for homebrew."

You should just for fun call one of your real saves from Ironfall Ironhax and upload that to the Miiverse... Just to look what Nintendo will do...

Obviously exactly the same thing. Is there even a way to tell based on a screenshot alone? And you'd still be making reference to homebrew software.
