You can format (create) the emunand without gateway but, if you wish to launch emunand, you must insert your gw card
I know I read too fast...
I try to launch my 9.7 emunand with the gateway 3.2.1 menu (classic mode) but it don't work without gateway I think...
I'm sure emunand has nothing to do with the card, it is just a simple restriction that gateway team put on it, one could remove it by using reverse engineer on their launcher.dat, I've already tried that but they use some kind of encryption on it, so I would need to decrypt it, make the necessary changes (remove the need for the card to be in the slot), re-encrypt and use it...
The gateway cart is just an drm dongle. You would be faster if you visit 3dbrew and write your own launcher and not try to decrypt gw stuff.
Perhaps but this is weird on the 3.1 update launch a 9.5 emunand without the card just work perfectly.

problem is I have no experience in the 3ds scene, I am a experienced guy in reverse engineering, software engineer and BIOS Guru @ BiosMods.com...
I could learn for sure how to write my own launcher but it would take lot of time to learn everything from the beginning, specially loading roms as there is no public resources on that matter...
I'm gonna take a look at rxTools sources, maybe I can get it to be compatible with N3DS
Realy ? I start with that when the last update was 9.5... Perhaps it was with the mt card launcher.

Yay, MT Launcher works, but no N3DS support.
Gateway though, Even if the launcher ask me if I want to launch Classic Mode without the DRM red card, it only leads to a blackscreen, which pisses me off. Their launcher must be fixed, this option is bullshit.
I think he has just finish his school trip, wright ? Anyone know his planning ? ^^
I think we have to make this happen for the N3ds users.
Edit : (To all of us) Don't forget there is a donate button inside the download section of rxtools website, this is for the glory of 3ds scene !
(my advice) Roxas makes the most powerfull tools of the scene, it could be soon the first cfw working on all 3ds with a lot of way to launch it and it cost nothing !
And remenber that his choice to not enable piracy does not mean that is not capable to do it. He just don't want to have prblm in the future then he works harder to protect his tool !
