Like a factory defect, or software problem. If your console is modded, then breaking doesnt count, cuz you may have broken some software or hardware in the process. Human error also doesnt count. If its a hardware problem, it must be a factory defect.

My ALBW 3DS had an issue with the audio jack ever since I got it, where the audio would sometimes cut in and out. It wasn't too bad, so I just ignored it. Eventually, it became so bad that the audio wouldn't work in one ear, and audio would cut in and out when the headphones move even a little bit. I got it replaced with the NES 3DS for free, which is what I use now.

I have had 3 3DS, all perfect. My friends collectively have an additional 4 3DS (That i have seen, my friends have like 7), i didnt examine them, but 3 of the 4 were perfect from what i can tell, and the last my friend says was perfect at the time he bought it, but at some "random" (as in, he claims to not know when or how) time, it broke... It functions, but the screen flickers or stays with wierd lighting, contrast, and colors when not in a certain position.

I've had many 3ds systems and the only problems were uneven pressure on 2ds d-pads and screen self-scratching on original 3ds's. Otherwise, rock solid. A decided improvement over the DS family (the lites were terrible).

I have a 3DS XL, that 9 out of 10 says that it can't access the SD, any installed game does not show up.
It suddenly started to do it, it always worked fine before, Formatting does not help, nor does using another SD (Sandisk / Samsung / Kingston / Transcend)

(Nothing modded, nothing done to it, it's on Official FW 9.6, no Flashcard is ever used on it)

My day 1 O3DS had 8 dead pixel. I also got a replacement the same day from the retail store.

Hmm, of my 6 Ds's 5 of them were purchased flawless. 1 was given to me in pretty bad condition...

it has a hinge that doesn't hold the top screen up, the bottom screen is cracked, and there is a small crack in the right part of the hinge, which is probably why the top screen doesn't stay up.
