The retail store Palacio de Hierro mistakenly published 6 PlayStation 4 consoles on their website at a price of 500 Mexican Pesos (38 USD).

People who bought these 6 consoles were notified by the store that their purchase was not valid due to a mistake in the published price. Given this, the customers filed a complaint with the PROFECO (government organisation in charge of defending the rights of the consumers), and presented the necessary proof to appeal against the store's decision.

The verdict of PROFECO was that the store had to sell these PlayStation 4 at 500 MXN or else they would be sanctioned by paying from 34,650 up to 226,000 USD.

This is interesting. Don't stores have a part in their terms of service that wrong pricing can be adjusted later in case of a large error? :blink:

This reminds me of that news Best Buy had Xbox One consoles for $50 (or something) and there was actually a few who snatched them. It sucks for the store to pretty much give them away for free, though.

There's an article in the Federal Consumer Protection Law of PROFECO that states the following:

ARTICLE 7.- Any supplier is bound to inform and respect the prices, fees, warranties, amounts, qualities, measurements, interests, charges, terms and conditions, time periods, dates, modalities, reservations, and other conditions which such supplier has offered, assumed, or agreed upon with the consumer regarding the delivery of a good or the rendering of a service, and under no circumstance can these goods or services be denied to any person.

ARTICLE 7 BIS.- The supplier is bound to exhibit in a prominent manner the total amount to be paid for the goods, products, or services such supplier offers to consumers.

Whatever the case, going against the verdict of the government is almost no option (not that is good, but that's how it is).

Apparently not in Mexico, but yeah, plenty of times (in America) I've seen signs upon entering a store correcting erroneous prices in the weekly sale fliers. That's the main thing, they have to put up notice that there was an error, they can't just wait until you're at checkout and be all "oh yeah, that's 500 not 50..."

I bought a DS Lite bundled with Layton's Curious Village for £2 and it says "preparing for dispatch" so hopefully it gets through, I know that this is being undersold but I don't care it was the seller who put it up anyway.

Good. It was the store's mistake, the purchases were valid, they need to own up to their mistake and sell the systems.

It's good for the customers but the staff members will obviously get punished for it, even those who didn't take part in it.

I remember that due to a price ticket being in the wrong place the customer complained and then he (or she I don't remember the person any more) got it for almost free but frankly, it was a piece of shit Nerf gun. I don't get why people like Nerf guns, the bullets are crap quality, get stuck, ripped and then you have to buy new ones to be able to use it again.

If it was bought and payed for, most countries will take that as a binding contract to supply the goods. When Steam makes a mistake by putting a game with too high a discount, they honor your buy too.

Many stores here in N.A. have a nasty tendency to put the wrong price on an item but have the right price at checkout. Then again, 1/5th of the time, fast food restaurants leave something out of the order that you payed for. It's never in your favor.

I've always believed that once a deal is agreed upon (cash exchanged) that the deal is final. Failing to deliver goods after purchase is a breach of contract and should be heavily penalized. I've made mistakes when selling goods on ebay and when I do, I absorb the mistake. It makes me more careful in the future.

A friend here on Mexico works in Wal-Mart, and he told me once that when a price is set on the ticket labeler, it modifies the price for ALL the devices, cash register included, so if an item is sold in a price lower or higher, neither the store or the customer will notice until the inventory is done, then they are aware of their mistake and do not take any action against the customer. Many employees benefit themselves of this type of mistakes, even he tolds me when a limited offer is up and inmediately I go to get some good deals.

That would be considered abusive here in Chile, and companies can't do anything about it if they made the mistake. The other day in an online retailer, there were for a few minutes tablets for like 4 usd.

I don't care. The purchase was made, the deal was sealed, the contract was signed, rubicon was crossed, finito. People have to own up for their mistakes and the customer is always right. If you signed a contract without knowing something, it's too late too - you signed a contract. They made a sale and that sale is final.

I would immediately sue. The price tag said X amount of money, I paid that amount of money and went through check out without any issues. My end of the bargain is sealed, where are my goods? It's different when it's a server error, when the tag said $X and the server only requested $Y from my bank, that's a whole different story. If the amount paid matches the amount requested, I don't care.

This is business - you don't get to backpedal on sh*t if you make a mistake. Don't put up merchandise without double-checking the price, managing the store is the store owner's responsibility.
