If you search for 4.5 you'll miss the 4.1-4.4s.

Just search for 3DS XL firmware. You'll find all the ones that list the firmware version. About half of those are 4.1-4.5.

Or gateway 3ds - I also just search for 3ds xl that don't say in the listing and email the seller and ask them to check and most will

I picked up a second hand XL on eBay last week. I overpaid a bit but it was mint and on 4.4.

Generally the people who actually advertise the firmware as being Gateway compatible overcharge because they know people are desperate. I simply messaged about 15 people asking politely if they could check their firmware version (and provided instructions on how to). I eventually found the one I bought but most people I asked had actually updated.

yeah, basically if its 4.x they will advertise the firmware (and overprice it), you can put either 3ds xl fw (some people just put fw x.x.)
but other cases there are lots of people who have a <4.5 console without knowing it, so basically you need to politely ask them the version (and make sure they dont update in the process)

I agree with the others just email the sellers and give them the Maximum firmware you will accept, also make sure you tell them you are buying the item based on what they reply to you.
Also make sure the item is new... As if its second hand then the firmware does not matter...

I found a mint condition 4.3.0 3DS XL on eBay only a couple of weeks ago for really cheap. My advice is to search for every 3DS and just click through all the results and check out the images. I found one where they happened to take an image of the firmware version, but it wasn't anywhere in the item description so no-one else noticed it.

Might take a while to find a good one, but this worked for me after an hour or two of searching ;)

Some people though might fake the images and what not... Just out of curiosity how much is really cheap?

I don't want to spend over 150 for a 4.5 as thats how much i paid for the one i currently own and that was with 3 games. why would the console need to be brand new ? if you got a 4.5 can you still use the wi fi features like wonder trade on pokemon x or would you guys not to advise going online with a 4.5?

lot to think about. i do want a 3ds that i can play my back up's on but i spent a month on craigslist waiting for a deal like the one i got and it was my friend who auctually posted his

I got a 3DS XL from a pawnshop on 4.3 for $160.

But after seeing the prices on ebay, damn I live in a large city time to go buy out the pawnshops and resell them on ebay.

You don't need a new one, for any reason other than to say it's new. Just tell the people behind the counter you're looking for a specific one (avoid saying things like rare or anything though). Most pawnshop people are fine with you trying stuff out before you buy it, they've even let me hook up consoles to TVs in the shop before I bought them.

The reason why I mentioned buying a new one is if you are going to be relying on serial numbers to buy the 3ds. As if you buy one that is second hand its likely the owner would of updated it, unless stated otherwise.
If as you mentioned you can try before you buy then you won't have this problem, hence a second hand one should be fine

£120 with case, screen protectors, spare styluses, game case and 4 games. Reasonable for a standard 3DS XL, but really cheap IMO for a Gateway compatible model these days.

And call me too trusting, but I highly doubt many people would go to the trouble of faking an image of the firmware. If they did you can just open a dispute with eBay/Paypal and you'll get your money back regardless so not much risk involved.

Keep messaging eBay sellers and keep looking around, that's what I did. I also tell them that I didn't want it updated, just in case. I bought one from a second hand store and it ended up being on 4.4 firmware so I kept it. Always another good place to check. Maybe even try EB Games. :)

I doubt that Ebay would approve a dispute based on a number on the corner being wrong(as they see it) Unless you emailed the seller before hand making it clear this was key to the purchase. Ebay would say its not a significant difference otherwise.
That is a very good price, I got mine £155 but new. I guess you can sale your games on Ebay and make some money back :)

It's a misrepresentation of the product, the version number being in the photo implies the system will be that version. With decent debate skills and knowledge, they should go in the buyers favor, if any problem is given at all.

I bought my 3DS XL v4.4 at EBGames (or GameStop) 2 weeks ago. You just have to check for the 3DS that has on the box the code SW12XXXXX (or lesser, ex SW11xxxx, SW10xxxx..). Mine was SW12xxx and came with v4.4.

I though they would never have one in stock but the thing is that they have a big "Price Sticker" sticked to the 3DS box on the front and they always sell the boxes behind that one :) so they dont have to stick a new sticker everytime. They had 2 compatible 3DS in stock

Well you could always try... I still doubt Ebay would see it of significant difference. Especially if you don't mention why you would want it to be on a lower firmware, i.e. Gateway
