I picked up a second hand XL on eBay last week. I overpaid a bit but it was mint and on 4.4.
Generally the people who actually advertise the firmware as being Gateway compatible overcharge because they know people are desperate. I simply messaged about 15 people asking politely if they could check their firmware version (and provided instructions on how to). I eventually found the one I bought but most people I asked had actually updated.
I found a mint condition 4.3.0 3DS XL on eBay only a couple of weeks ago for really cheap. My advice is to search for every 3DS and just click through all the results and check out the images. I found one where they happened to take an image of the firmware version, but it wasn't anywhere in the item description so no-one else noticed it.
Might take a while to find a good one, but this worked for me after an hour or two of searching
I don't want to spend over 150 for a 4.5 as thats how much i paid for the one i currently own and that was with 3 games. why would the console need to be brand new ? if you got a 4.5 can you still use the wi fi features like wonder trade on pokemon x or would you guys not to advise going online with a 4.5?

Some people though might fake the images and what not... Just out of curiosity how much is really cheap?
£120 with case, screen protectors, spare styluses, game case and 4 games. Reasonable for a standard 3DS XL, but really cheap IMO for a Gateway compatible model these days.
And call me too trusting, but I highly doubt many people would go to the trouble of faking an image of the firmware. If they did you can just open a dispute with eBay/Paypal and you'll get your money back regardless so not much risk involved.
I doubt that Ebay would approve a dispute based on a number on the corner being wrong(as they see it) Unless you emailed the seller before hand making it clear this was key to the purchase. Ebay would say its not a significant difference otherwise.
That is a very good price, I got mine £155 but new. I guess you can sale your games on Ebay and make some money back
It's a misrepresentation of the product, the version number being in the photo implies the system will be that version. With decent debate skills and knowledge, they should go in the buyers favor, if any problem is given at all.
