Hacking Credit Card Dispute for Gateway 3DS?

I need to return a GW3DS unit back to a reseller (A GW official reseller at that) but they aren't cooperating in the sense that they haven't responded to my email (it's been 10 days). I was wondering was there anything I needed to know or do before I call my bank? I used my bank card. It says debit and purchases with it are taken out of my bank account but you can use it as a credit card as well because my bank partnered with MasterCard. Is it as easy as calling MasterCard and saying I want to file a dispute for a flash cart (or should I even say the item is a flash cart)?

Good luck with a credit card dispute over a device with very shaky legal standing (an illegal device in many countries, in fact) - you're better off attempting to cordially resolve the matter with the reseller again, perhaps they missed your message or it went into spam. In the event that you'll fail to get in contact with them, you can always take the matter straight to Gateway and see what they say.

But surely there is a way to get my money back with the credit card dispute? I've heard of others doing it successfully. Although with them, they never received the item.

If it's a debit card, you must go through your bank. MC would just be the network they used to process it.

How long have you had it for? Unless the reseller stated there was a warranty period - they'll probably deny it outright. Not to mention, the legal standing on such a device is pretty awful at best. Wouldn't be surprised if they denied it outright.

And once you initiate the chargeback, the seller gets a chance to respond. If they can provide the receipt and delivery of the unit to you with no mention of warranty, you're up the creek.

I'd give it some more time. Unless you just got it and it didn't work.

If you have had this unit for more than a few months, it's going to be a tough road trying to get a refund.

I work in a bank, just go and file a complaint about how you did not buy it. Tell them you don't even know what that is and you'll get a refound.

Filing a false complaint over a few dollars is not the way to go.

The official gw3ds reseller probably would comply if the op was exchanging the item because it don't work, I don't think the reseller needs to refund his money though just because it was an impulse buy. Suck it up, $80 aint a whole lot of money, and quit buying stuff you don't want.

So the gateway is faulty and you'd be happy with a replacement? It's not that you just dont want it? Most seller's policy is a replacement if you return the faulty item within their warranty period.
Others are replying based on you just not wanting the cart but I cant see you stating that.

My first gateway died after a few weeks, couldn't be bothered with the hassle of returning it to Hong Kong. Got another after omega came out and it's working fine.
I guess it depends if the money is really worth dealing with getting a refund.

If you've asked for a replacement within the warranty period with no luck and you paid by using the credit card feature of the card then you can call your bank, say you purchased a gaming accessory online, that it doest work, and that the seller is not responding. I wouldn't mention 'flash cart' outright but certainly dont lie to them if they ask for specific details.

I decided to just buy from realhotstuff since they were in NJ and I'm on the east coast as well. Got it from realhotstuff first. r4cardusa came a week later. It ended up being defective anyway. The r4cardusa website, http://www.r4cardusa.com/page.html?id=31 , claims easy returns. Even if the item wasn't defective I could get my money back minus 20% . I have 2 Gateways now.

I don't think they are US based.....probs just say that to get sales.

That's not even the same site lol, always good to do your research before ordering from sites and don't take what their site says as reassurance

If your going to try and get a charge back from your bank my advice is don't commit fraud, the bank can easily confirm details with the seller, then you will be out more then what you paid for a grey market purchase. Sometimes we get burned when we deal with sketchy stuff, lesson learned move on if the seller doesn't want to help?

If the Gateway you purchased is defective, I believe you are legally entitled to a refund or replacment regardless of the stores policy. That's how it works in Australia, but I am unsure if that is the case in America.

If it works and you want a refund because you changed your mind, you're out of luck unless the store allows you to return it (very doubtful).

Well that clears a bit up. It says on the site to login to your account and check the orders and hit the "Return Item". Don't know if that's been done.

You can contact the bank if it's a defective unit. But if you initiate a charge back, the seller still gets to respond. They can either refund, or replace your unit at that point. Or if they never respond the bank will refund you. Your only bet is to claim a defective product. Trying to claim you have no idea what the charge is will get you in a lot of trouble if the vendor can produce a receipt, e-mail address, your home shipping address, and a receipt of delivery. Banks are pretty peculiar about chargebacks, as they usually put flags on your account. So use it wisely.

Well, since you are in the US, check your state's Lemon Law, this law varies state by state. However, this law normally only cover goods that are buy/sell at the same state.

Aren't flash carts legal in the U.S? I know that in Japan and the UK it is illegal.

Illegal to ship or sell, technically you can still legally own one. It's like this in a few countries, the legal status of the devices is debatable and completely in the grey area.

My honest suggestion? Don't try and commit fraud with the bank. Your best bet right now is to talk to your reseller and arrange a refund if it was faulty; most resellers would be happy to assist you in that matter.

Not in the US - in the UK and Japan, as well as a few other countries that I can't quite recall. It's not a penalty for customers, it's a penalty for resellers.
