To the best of my knowledge, which is lacking over the last couple of months, the only people to be banned in recent times have been those that did things like profile sharing and other XBL exploits like that (there was a region swapping one more recently than profile sharing), RGH/JTAG people, those that modded their profiles for achievements (but badly) and those that managed to be even more of a cretin than the rest of xbox live.

I am not even sure anything came of the picture loaders.

People are getting banned due to older hacked DVD firmwares (iXtreme 1.6 on new dashes)
Older Xkey firmwares on new dashes.
Profile sharing and the Non-JTAG hack.
Hacked profiles (external profile modding tools used to cheat achievements)
JTAG/RGH owners that are stupidly enough to connect to live.
People that don't patch their backups.

Mostly using outdated firmwares and not patching their backups.
I read somewhere that close to 2 million consoles are banned.

If you go over to the Xk3y forums I think you'll find there have been 1 or 2 bannings on Xk3y which is due to some compatibility issue between drives over 2TB and Xk3y. However, other than that I've never heard of anyone banned with it. I've had mine now for 6 months, play everything early (because frankly I dont really care now anyway because the 360 is close to the end of its lifespan) and I'm still going strong.

I have a system that got banned due to a weird problem with 4TB drives. The short version is the embedded version of Linux used in the latest xk3y firmware is not fully compatible with the advanced format of 4TB drives. Depending on the specific firmware version on the drive (only tested it with Seagates) and the formatted cluster size - the xk3y can mess up and load the wrong data from ISO's which makes the Xbox think you are playing a modded game. If you keep your cluster size at 4K you should be ok. If you bump it to 32K or 64K then the xk3y messes up with certain 4TB Seagate drives.
