It's still good that a country set precedence. Not always, but sometimes a foreign court will take that into consideration when making their decisions. There's been a few cases where a court has made their decision entirely on another courts decision. An Italian court is not a bad place to start.

Nope, that's for sure. Still, never thought I'd see the day where console modding was deemed legal.

Yeah, but there is a difference between a "console hacker" and a guy who is selling hacked consoles.

In the US, I think it would be very difficult to prosecute someone criminally or even get a civil judgement if all they are doing is hacking consoles and publicly releasing the information or code that allows it (and such a suit might finally resolve some issues with the DMCA).

On the other hand, if you are profiting from the sales of hacked consoles, I think a company like Nintendo might have a valid case against you, especially if it can be shown that the overwhelming use of your product is copyright infringement, as in the Napster case.

Well it's not like cops are gonna bust down my door if I manage to jailbreak my Wii U on my own here in the U.S.... but yay, I guess? Legality has never stopped Apple jailbreakers from releasing their jailbreaks.

It's a shame that "jailbreaking" a Wii U impossible due to the fact that it's not running on any form of FreeBSD, Linux or Unix.

...and even then: this is a ruling, not exactly the law itself. At best, it sets a precedent for similar Italian cases. The influence in other countries are going to be pretty much none (or 'negligent', if that's the correct English word).

When you're a large company (such as Sony and Nintendo), if you wish you can do whatever you want, regardless of the law.
