According to Serebii the old bank opened several server connections to the eShop, Nintendo Network AND the bank servers at the same time. So the banks connection method might have just been so bad they unintentionally DDoSed the servers.

As long as the Pokemon could be gotten through legitimate means there is no way to prevent them from being imported without potentially blocking real mons.
