I hope Ninty does it.

Cheaters don't deserve online play.

Exactly my sentiment. In most cases, you either choose online play or having a hacked console. Cheating pretty much destroyed online play for DS games. I don't want to see the same thing happen for 3DS.

I agree... but most people will just be using a hacked console to pirate. Whether you approve or piracy or not, it's hard to argue that it hurts the online infrastructure and, therefore, should be a bannable offence (though that hasn't stopped Microsoft and Sony from doing it in the past). But cheating, oh yeah. It'd be nice if the 3DS is kept free of cheaters for awhile.

Also Nintendo has banned people before for cheating, but I don't think people were ever banned for just piracy. But Nintendo might change their minds on the matter. Hard to say.

Pirate all you want for all I care, just don't cheat.
Why people create cheats in the first place is beyond me.
Imho, that's the worst drawback of a hacked console/handheld.
Cheaters.

I don't even care if you cheat offline. Just don't cheat online, and don't take your cheated profile online.

Nintendo barely understand online multiplay to put any value to it, due to this there are few safeguards against online cheaters. This basically leaves the implementation of any safeguards to the developer/studio/etc.

Example: Capcom policing the MH tornys.

Since the OP is fixated with pokemon, he would have to look to gamefreak and their implementations of any safeguards.

SWIM has a flashed 360; most of the games this person downloads are game they would have never played anyway; in addition SWIM pays $60 a year for online gameplay so this person doesn't feel all that bad. I do see it as a moral gray area.
(Most new games for the consoles require a online pass, forcing anyone who buys the game used to pay a extra fee to access the multiplayer features. I don't see why a similar system couldn't be implemented for the 3ds.)

My 3ds got banned trying to use Gateway online. Says "Unable to connect to Nintendo Network. Reason: Banned."

I found a bunch of miiverse bans but those were all on the wii u. There wasn't any mention of any Swapnote associated bans.

So I would have to assume that your ban was wii u related.

Yeah, just do a simple google search: "Unable to connect to Nintendo Network. Reason: Banned"

No results. The dude is most likely trying to spread paranoia.

There's a little problem, gateway does not support online.
Gateway doesn't make going online impossible. It just makes games going online impossible (to my knowledge). You can still access the eShop using Gateway, but you'd have to be pretty darn stupid to do so. I've used the browser while playing my Gateway tons of times.
