If you make a rule for yourself not to hit any buttons on the 3DS main menu (ie. you only use the stylus to tap games and whatnot, not button-mashing A/B to get into a game), you're unlikely to accidentally hit "yes" to update.

Yeah, it would, but I'm not sure what would happen to Pokemon's save file because of the weird protection it has and it will erase everything you ever downloaded from the eShop. (of course, if you never downloaded anything this is no problem)Formatting the system removes the update notification
