I meant as in safe to play online without it asking for an automatic update as I would like to stay on the lowest firmware posible incase some new exploit comes up.

edit:
Ty Arnold, I will see if I can play online without updating when I get home, I have the collectors edition pokemon 3ds xl (red) aswell.

It's safe to play online while staying on 6.1. I get a nag screen at the 3DS main menu from time to time to update to the latest version, but I just hit "no."

^ Pretty much that. It is safe, but there's a good chance you'll end up with the "update now" screen every 24 hours or so.

If you make a rule for yourself not to hit any buttons on the 3DS main menu (ie. you only use the stylus to tap games and whatnot, not button-mashing A/B to get into a game), you're unlikely to accidentally hit "yes" to update.

That's probably my biggest fear. Besides turning off wifi, is there a way to turn off update notifications?

I might be wrong, but I think even if you turn off the Wi-Fi, if the update nag is already appearing, it will continue to appear even with Wi-Fi off since it has already downloaded.

Formatting the system removes the update notification :)
Yeah, it would, but I'm not sure what would happen to Pokemon's save file because of the weird protection it has and it will erase everything you ever downloaded from the eShop. (of course, if you never downloaded anything this is no problem)

That's for sure. I hope he will strike a happy medium.

Then just learn to live with it. It doesn't matter if you accidentally press A when the update notification pops up, it will ask again if you agree with the terms and conditions, and at that point it won't let you proceed unless you tap the "YES" option on the touch screen.
