Hacking to update my 3DS and replace my Acekard 2i?

I recently bought a Pikachu 3DS XL, it wasn't updated to the latest firmware when I got it so I'm able to play my Acekard on it. Nintendo have the offer of a free game when you register your new 3DS XL, I registered and everything but of course, can't access the eshop because my 3DS isn't updated.

Is there anyway I can access the eshop without updating to get my free game? (I'm guessing not but it's worth asking)
If I decide to update my 3DS to the latest firmware, is there a card that will work with my 3DS when it's updated? If so, which one?

You will need to update to get the free game.

The DSTWO should be your choice of flashcart after updating.

Probably a stupid question but is it illegal to buy one for personal use in the UK or just to import them and sell them on? I'm a bit paranoid about buying them.

I wouldn't buy anything as 3ds is gonna be hacked to play 3ds roms/homebrew and rls soon, and you may end up needing to buy another cart or adapter in the end.
