So I heard we can transfer our Wii Virtual Console games to the WiiU.

Here's the questions:

Who will be the first to try transferring the VC games installed "illegally from HBC" to a legit WiiU console?

Will this work?

i doubt it, because if it is anything like the DS-3DS transfer it will need to go online and verify your licenses

I have Pal save files and Ntsc save files on my NTSC Wii.
I am getting a NTSC WiiU and I would guess that all my Wad installed channels wont be transferred and my pal save files which is 100% okay for me.
But I just am a little scared that I might lose my warranty if I do the transfer.
But I just want my Zelda skyward sword save file on my Wii U.

People can you tell me if it is safe and if I will lose warranty?

its probably safe to transfer stuff, even with a modded Wii

The Wii will analise all that you have and then list what it can transfer to the SD card and what can't before the process really begins (some can be transfered, some need to be re-downloaded from the Wii U eShop, and other can't be transfered at all). There is no system modification involved.
If its possible to transfer the "homebrew originated" things, only some tests will say ...but it's probably safe to try.

EDIT:

Here are some things from the new Nintendo FAQ about the transfering process:

  1. If I transfer my games from Wii to Wii U, can I keep the games on both hardware?
Once the games are transferred from Wii to Wii U, the games are no longer usable on the Wii hardware.
  2. I forgot to transfer my digital games before I traded in my hardware, can I get these games back?
Once the console is traded, we have no way to retrieve the data.
  3. What Data is Transferred During a Wii to Wii U System Transfer, and what data is not Transferred?
The following is transferred during the system transfer process between a Wii and Wii U:
  • Wii Software Save Data
  • WiiWare and Save Data
  • Virtual Console titles and Save Data
  • Add-on Content
  • Wii Points
    • These points will be combined with the points on the target Wii U system, but cannot exceed a combined point total that would exceed 10,000 Wii Points
  • Wii Shop Channel Account Activity
  • Mii Characters
  • Nintendo Wi-Fi Connection data
The following is not transferred during the system transfer process between a Wii and Wii U:
  • Data from Wii settings
  • Preinstalled WiiWare software and preinstalled Virtual Console titles.
  • Software and save data for which transfer is not permitted, such as WiiConnect24 data
  • Software that is present on both consoles
  • While the software will not overwrite what is already on the target Wii U system, the new save data will overwrite what is on the Wii U.
  • Nintendo GameCube Game Disc save data

My Wii is on 4.2 and has Priiloader and bootmii set as boot2 which runs all my eShop purchased VC titles and disc games from an ext HDD via usb loader gx. I don't HAVE to transfer these (VC titles only) and can still use the Wii along with my Wii U but would like to do it if it's possible.

What I obviously don't want is a fully formatted Wii running the latest firmware and having to set it all up again from scratch. Any recommendations?

My Wii has an undeletable channel
Some old pirated copy of Majora's Mask. If I ever attempt to delete it, the console freezes, and on rebooting, cannot access the data management screen. Doesn't matter what I use. Channel management, WAD manager, Any Tile Deleter, what have you. All of them freeze and come back with a semi-brick

I stuck the channel in the corner. I hope the transfer app doesn't try to delete it. I don't think it'll be able to.
