Hardware Who read the 3DS Service Agreement?

I skimmed through it when I first set it up, but didn't notice anything unusual. However, ShadowSonic2 mentioned to me that Nintendo said they have the right to brick your 3DS if you break the agreement, so I went and took a closer look. I'm not an expert at legal documents, but this is what I got from it:
  1. Whenever you connect to the internet, logs of your activity is uploaded to Nintendo's servers
  2. Your 3DS can update without asking you

Nintendo doesn't have the right to brick your 3DS.
They do have the right to turn it into a "brick" by disabling everything online.
Much like Microsoft does with modded 360's

Iirc Nintendo already got into trouble by silent updates.
edit: They did got into trouble by the faulty boot2v4 update wich bricked virgin consoles.

Big Brother has access to (and legal ownership of) pictures of your children now.

Dude, there was like 20 threads about this same exact thing when the 3DS came out. There was even one guy with a petition or something.

I think you can disable that, no? Even if you can't, that'd be unfair because we don't want to have people snooping with what we play.

That's just wrong. What if we take photos that we... don't really want to... share...? It's a complete invasion of privacy!

There were so many threads and it's been proving false. They can't brick it if say you use a flashcard because some countries made flashcards legal. They could disable you from going online. That's it.

Have they specifically said they would ban people from online for using unauthorized devices?
(Besides, the 3DS cannot know I am using my DSTwo, since if it did, it would block it.)

A good way of preventing pirates from accessing online is by doing what JwtB did.
We still haven't bypassed that limit. (Sure, it might be because of the lack of interest.)

But having a unique cartridge and save file ID is an effective method, since pirates would all have the same cartridge ID.

I know there were lots of rumors going around (and threads for those rumors), but I hadn't seen any about Nintendo flat out saying it. Take a look at Chapter 3 for example:
You understand that the Nintendo 3DS System specifications and the Nintendo 3DS Service, Software, and Content are constantly evolving and that we may update or change the Nintendo 3DS System, the Nintendo 3DS Service, Software, and Content in whole or in part, without notice to you. Such updates may be required for you to play new Nintendo 3DS games, enjoy new features, or continue to access the Nintendo 3DS Service. After the Nintendo 3DS menu is updated, any existing or future unauthorized technical modification of the hardware or software of your Nintendo 3DS System, or the use of an unauthorized device in connection with your system, will render the system permanently unplayable.
That's not talking about online, that's full on bricking. It's just like the 003 error on the Wii.

The thing is, since we accepted the agreement, it's legal for them to do it.

That doesn't really matter. I doubt parents want people spying on their kids. Everything you make with a 3DS becomes Nintendo's property.

I wouldn't call it spying, it's probably just used as some sort of security risk, like if you have photos or videos of criminal activity. Nintendo wouldn't hire a bunch of pedophiles to look at photos of children. Additionally, if a parent was worried stuff like that would happen, why would you give them a 3DS?? Parental Controls prevent the taking of photos. Children shouldn't have access to that stuff anyway.

If you put something on there that isn't compatible with their stuff, and it bricks your system, it is not their fault. It is yours. Nintendo can guarantee that your system, when under normal operation, will continue to work as such, or they will replace your system. Nintendo cannot guarantee that the system will continue to work when something out of their hands is done to the system. That is why they put those words in there.

EDIT:

In fact, if they had used the word "may" instead of "will", then they are basically telling everyone that there is a chance nothing will go wrong, giving people the idea that making such modifications can result in continued operation, even though they have no control over what is happening. They are merely putting in the worst case scenario since they don't have the grounds of a truly better scenario.

For those thinking that it gives Nintendo the right to brick your system, it says nothing of the sort about that. This is just people being way too paranoid. Remember the person from here (I can't remember the name) who sent their 3DS in to Nintendo for repairs, but accidentally left his/her flashcard in the unit? Had the words been taking to the extreme that Nintendo would brick units as such, then he wouldn't have gotten his 3DS back in working order. They did dispose of the flashcard, but the 3DS was repaired.

They said the update will do it, not the device. It's just like the 003 error on the Wii. They specifically check for the korean key in the SEEPROM and if it exists on a Wii that isn't set to the Korean region (i.e. the update isn't a Korean one), Nintendo will brick your system.

Not a physical modification, and the change itself does not cause the brick. Korean Wii's only have one thing that separates them from other regions as far as software. It's dubbed the Korean key. You can prevent Nintendo from completing the check by installing IOS60 into slot 70/80. When it can't check the key, it won't brick it. More info here:
