I, for one, sort of hope, maybe strongly hope, that the 3DS never gets hacked. Sure I have a flashcart for my DS and I have tons of emulators and backup loaders on my Wii, so it's not an ethics thing. I've "backed up" plenty a Wii game in my day.
My point is that when a console is hacked, it depreciates the value of data, for me anyway. Take Pokémon for example. Event Pokémon are supposed to be super rare, only available at a certain time. After that, you're screwed. But you're really not. People clone them (I have) or they rip the distribution cart so anyone can distribute them. It depreciated the value of the data. If I get a cool event Pokémon, I wanna be glad I got it. I wanna feel pride. The same can be said about Animal Crossing. Some items are only given out as DLC at a certain time. But you can just run a homebrew app and get all that DLC. There goes the rareness of it.
More on Pokémon, I don't like that people can just use Pokégen and create the perfect team to battle with. I want people to actually work for their Pokémon, take the time to get the right natures and IVs. And shinies too. I don't wanna see them everywhere on the GTS or while playing online. I want them to be as rare as they are in the game.
I also enjoy buying games. It's good to have a physical collection. I've suffered from piracy syndrome before, I believe it ruined a lot of games for me. When I was younger I would play a game to beat it, ask my parents for a new game and (hopefully) get it. I haven't seen a credits screen in I don't know how long. Now I just play a game for a bit and get bored of it. I always think there's some game that's better, that will hold my attention for longer than two days. I haven't been sucked into a game since Black and White came out, and I still didn't even complete the story. I put around sixty hours in, which is saying a lot for my recent gaming habits. I think the abundance of games I can play has just made games worse somehow.
