E-shopping gone horribly wrong...

I've been shopping on eBay for quite a while now, everything I've ordered has arrived, even if they take a LONG time. But I think this time I'm screwed, I was bidding on Sonic Generations for XBox360 and it seems I won the bid, $36 with free shipping to El Salvador...from the beggining I thought something wasn't right about that, I mean since it's a game that just came out recently, nobody sells it for less than $40, not even used...and on top of that free shipping just sounded too good to be true as well, since I've never paid less than $7 for a game to ship here.

So eventually I decided to check the user's sold items...and it just got worse, for instance, I found he sold many "Brand new sealed" Mortal Kombat PS3 games at $25 - $35 or so with free shipping and Batman Arkham city at $16 also with free shipping, all of his sales are based on bidding, I don't own a PS3 or games, but I KNOW that game is popular and shouldn't sell at such a low price unless the seller plans to enter bankrupcy. In fact I'm puzzled...why didn't he use Buy it Nows instead of bids? Assuming this whole thing is true, he's actually losing money rather than acquiring it.

He just recently began "selling" actual games according to what I could observe, but before that, he was selling game saves, sending them to the buyers' emails it would seem, which is more credible. While the game save files sales were probably true, I don't believe for a second this person is selling brand new games at the prices I mentioned above...I'll leave some links below so you can see.

And I think that's enough...I tried to contact the seller asking him why he's selling the games so cheap, and later asked to see the mailing receipt for my item and he avoided both topics...saying something along the lines of "Yes I sent the item to your adress, and it is the actual game and not a save file, it will definitely arrive before christmas". I don't believe him at all...I'm sure he hasn't even sent it, why? because it doesn't FUCKING EXIST! sorry but...I was dying to play this game, and this just ruined my christmas...I won't be able to get it now. Please can someone tell me what I can do? I asked a friend of mine and he said I had to wait 3 more weeks before filing a claim so I can give the item a fair chance to "arrive". I need my money back soon so I can order a real copy...damn, what can I do...

You must wait... Next time be more careful. I check feedback for this specific reason. Sorry that we have no better ideas. :(

It's probably just a bootleg version at those kinds of prices. It's also possible that the seller is short-selling overstock or makes it up with volume of bids that goes over the retail value to make up for some that don't. The fact that the game is new pretty much eliminates overstock as an option.

Edit: Just looked at the auctions and ALL QUOTES IS BAD SIGN, LOL! ;)
 
How the hell can you create working bootlegs of 360 games? I don't think that's possible...also i've had it, tell me where I can open up a paypal case for this situation.

Cant you burn the ISO to a DVD-Rom like with the WII and PS3?
 
Yes...the Xbox 360 can read "backups" WHEN MODDED ONLY, selling that kind of thing is forbidden on ebay.
