Hacking and legality...

So me and my friend were talking(or debating...) about hacking and stuff, particularly video game consoles.

So the main question is, is it legal or not to "hack" video game consoles, where does DMCA stand in, and what are our rights in terms of ownership to the console? Can we really modify the software?

PS. This is out of curiosity, hope you don't go too off topic on morality and such

. Hopefully I'll be able to get some answers here

If I wanna update to the latest firmware but have games and CFW in my HDD, do I have to reformat/delete? Or can I just update and leave the remains?*

*to keep from being console/account- banned

Im playing on my friend's server...and it loads terrain really slow

Any reasons why this is happening? I'm running on Core Duo and GT 9400 as my graphics processor.

Could my internet be the problem? It got slow recently,but my friend's server is running on his pc which is near.(My friends can play just fine though)

My friend is gonna buy a Mac,and probably might install Windows(maybe 7)...does the disc have to be a retail/original version,or a burnt/pirated one will do?
