Try a brand spanking new one on Amazon. A used one may already be updated, but I got mine brand new last May on Amazon UK and it was 9.0.

there is a smash bros edition of the N3DS, released only in japan...
But idk if its an XL or not, i just know it comes with 8.1

I didn't know they made an MSU cart for the Genesis.... I knew about the SNES one and the library for that is rather large but the Genesis one has very few games+1
