Only if you're planning to play online in the future. If you don't, you won't be banned.

If you try to go online with it, it'll ask you in an endless loop to accept the EULA for the US region, but you won't be able to without using a leaked SDK app called "config.cia" (we can't link to it here). As for simply installing something out of region, the home menu won't even display it unless your CFW is region-free (which all of them are anymore, unless you're experimenting with CakesFW or Corbenik's advanced options and turn it off), but programs like FBI will still show and be able to launch out of region stuff.

depends. The region free games like pokemon should be safe to play online. Just play it safe. You don't want to get banned just because of that right?

That only happens to some people, I've never had that problem, and I've played out of region games online a bunch.

No, you will not get banned. There have been no reports of this happening. Not even online. It works fine. With a few games you might have to do the EULA thing in config.cia once.
