So if you enter Gateway mode (the normal way) it boots into a 9.2 emunand without signature checking, thats why it's possibel to install the DEVMenu .cia?
Basically a CFW on the fly?
And if you boot in to classic mode no patchs are made, and just boots into a emunand
Probably saying a lot of errors here :S

Correct, you can't run CIAs or the red card in Classic mode (but it is region free for retail carts). You can only run the red card and CIAs in gateway mode.

DRM as far as I know, but it does act like a game card once you press select and choose a ROM, of course. In terms of merely booting GW mode, yeah, it just serves as a DRM dongle.

And does the red card actually do anything on that patching or it's only needed for drm?

Technically speaking, you could run cia files without the red card. If someone wrote their own launcher.dat to tweak the payload to disable signature checks and install devmenu as a cia file, then you could use devmenu to install further cias. But as is, you need the red card to disable signature checking, and to install devmenu from redcard to cia.

Gateway team is likely paying quite a bit of money, either to contracted researchers looking for exploits for them, or for buying exploits from community. They have every right to try to lock it down and require you buy their product to use their work.

The red card is simply another mount point for 3ds roms besides the regular sd card. A multiman type setup is definitely possible, but any effort on that front would have to be started almost from scratch.
