Having a formal contract is good; much better than a few words and a handshake. I think you've got most of the bases covered.

Even I have my own attourney to make the contract.
But still don't want to ruin our little close to non relationship.

I know that you may think that I still can't get over her.
The fact is that we spoke two or three times in maybe... like 10 months togheter?

I highly respect every women, that's why I don't want to cause her any trouble in ther life, and don't proffit bastardly with her image.
That's why I'm considering the contract.
But if she's not allowed for whatever reason, i'd be pretty much devastated.

And yet again... as selfish and egocentric this may sound: I'm looking at her in a way to make a business. And yet don't want to force her to make anything she won't like to do. Even if that means that I'll have to stick with my weird method of working.

Afraid the position of likeness rights/personality rights, much less in Mexico or wherever your unknown target markets are, is an area of intellectual property I am not so familiar with. Assuming it works as my quick scan says then it is somewhat analogous to session musicians in music world (my band is recording but lacks a drummer, we hire one in for £100 for the day and all is good, later we get to number 1 and get mansions or whatever but the drummer still only has £100). I don't know what a typical art world contract is but waivers of rights to things could be one, or it could be a percentage is given or it could be anything else. A sound policy in life is don't fuck over your friends so maybe go with that.

To answer the other question is she not a big girl now, one sound of mind and capable of making her own decisions? To that end the worries are hers and she would appear to have considered that. Your concerns, while maybe not misplaced, are largely immaterial regardless of whether you are doing abstract, nude or "wow is your hand a scanner now?". The type of art may factor into her decisions but as long as you made it clear from the outset I can't see an issue.

The copyright/intellectual properties in art is pretty much like this:

As long as I don't make an EXACT REPLICA of an existing image, I'm not making anything illegal.
AND
As long as I MAKE AN EXACT REPLICA but I'm not making any proffit out of it, I'm not making anything illegal.

Those and other things to consider like... used materials, moral stuff (like painting porn... don't think that's possible) but there's a reeeeeeeeeeeeeeeeeeeally small line between what's erotic and what's pornographic.
Of course, that also depends on each person.

I actually... never thought that she's now a fully grown up woman, capable to make her own decisions.
Guess I still look at her the same way when we were 17.

If anything, I'm sure having her husband in the room would save her relationship from questions of 'infidelity' and might make it so you're able to do more work with her. You'll have no problems if you follow that route. Make both of them as comfortable as possible.

You also need to realize, you're in a business that not many people can break into. You never know what you'll get comissioned for in the future.

I have 4+ months to complete my paintings.

To me, Erotism means a way to rise desire without being toooooo logicall about it (nudes or something alike) but being careful, and just making the expectator to use the imagination to accomplish an artistic and personal matter.
I can go as poetic as you want.

I just said that I tend to look for adult aimed models, because many of them are beautiful and unrecogniceable...
On top of that... Erotic art pays well.

I got a laptop about 5 months ago, downloaded some Art-related apps and been learning them since then.
Then this opportunity came up and now I'm building my portfolio.
In short, nope. Nowhere to see my stuff.

You know, also, the style that I make takes a long time to do.
As one already said... my hand is a fucking scanner. And I make big pictures, so takes a long time to complete, specially because one can't make a single mistake when painting Hyper realistic art.

Business and copyright stuff aside (which I'm pretty sure you know how to handle), I think your dilema comes from unresolved issues with her, and by that I mean issues and feelings you have with your "idea" of her.
Oftentimes we go through life carrying stuff we create in our minds, ideas and stories we make about ourselves and specially about other people, and this ideas can become little cherished obsessions that plague our minds and emotions from time to time.
It's my opinion that the best way to resolve this kind of things is to try and be as direct and honest as posible, with people and ourselves (specially with ourselves), to avoid wasting precious time and to be as free as one possibly can, in mind, spirit and emotions.

My advice to you would be this:
Paint her.
She already knows how you want to paint her and she agreed in your terms, and even if you only take her picture and then use said picture to craft your art, it will be an excellent opportunity to clear your ideas about her and to really know her as she is at this present time, that way you'll have a better understanding of you and her.

Last time got LOTS of pictures deleted from my Facebook.
Apparently, someone got upset by the human body... and bye bye hard work/intellectual properties.
Now I remember what happened to my stuff... I just assumed that not doing a backup of everything I post there was a good idea.
Guess not
