this was likely a planned update they new was happening before the release date last week. the fact the carts were not blocked is still likely part of the gambit to get the cart teams to tip their hand prior to the north american release. nintendo is such a whore for recycling there is no way they've given up on these titles yet, they're likely still being used as bait so nintendo can eventually seal off the gates.

eventually, all the gba and ds games will start becoming available for download in the nintendo store.

ah btw, you can treat the 3DS more like a cell phone now. meaning it's always one. because this cool loader comes with the 3DS you just put it to the charge stand whenever you come home and just close the lid instead of shutting it down completely.
at least I observed this on my own behaviour. the 3DS pretty much is never turned off in my case.

If I wanted my 3DS to act like a phone, why wouldn't I just carry an iPhone instead? It does the same thing if not more than a 3DS. Nintendo really really needs to address this future problem with some better store integration and such. Otherwise your situation will come true where people are just going to have their iPhone or Android phones for gaming instead. Certainly you can't make the case that phones are not powerful enough to run games. Certainly visually the iPhone and Android phones can do things the DSi/3DS (other than the 3D thing) can't even begin to accomplish.

I don't agree, if what you say would be true, Sony and Nintendo wouldn't make new portable consoles.
The IPhone is nice, but its certainly more a phone than a gaming device.

Update: the Acekard Team has just informed us that the Acekard 2i update they've prepared is still functional after the 3DS firmware update (it does not get blocked) and they will be releasing the update shortly!
Update 2: the R4i DSN and R4i Gold (r4ids.cn version) are confirmed to work after the 3DS firmware update. It does appear that this first update doesn't block DS flashcar
ts.

I have developed for the iphone and the thing can't even push graphics at its own screens resolution. Same goes for ipad. These are not gaming devices.
The graphics a 3DS can push already wipe the floor with iphone4 and android and these are launch titles we are seeing. This is the worst the 3ds will ever look.

Only thing an iphone can do well over a 3DS is make phonecalls... And untill may - search online.
sorry, but iphone will never be as good as you want it to be.

The next iphone or future android still will not even cut close unless they change the arcetecture of the device completely. Maybe some buttons would be of use too. Just a thought.

For people worried about forced updates: the law in many countries prohibits the installation of software on a privately owned hardware device without the agreement of the owner - hence the EULA/GNU boxes that pop up when you install software on a computer - the DSi updates had them too (at least in Canada). Ask Sony what can happen to a company that 'forgets' to ask someones permission before installing software on their device.

I believe they are also required to give a full explanation of everything an update does - if you choose to you can read a full explanation of every update Microsoft sends out - that's how people avoid the WGA crack-killers.

A patent lawyer friend of mine actually told me that he could argue in court that even if you check the 'I agree' box in a software license it's not legally binding because most people just scroll past the fine print and software companies can't prove otherwise.

@Waves : On the video you made, it seems like your 3DS wake up state happens earlier than the DS.
is the 3DS always lite even when closed, or is the switch really sensible and the 3DS wakes up on a short opened angle ?
It seems there's a "click" state when closed too, is that the case ?

can somebody please tell me if it was a forced update? Or did you have to agree to something first?

As myself and a few other members have been saying for 6 months.

I'm not connecting to wi-fi until May, I don't need at this point since the Virtual Console and web browser won't be here until May.

No-one knows what Nintendo is thinking or doing, and it may be unsafe to start developing flashcarts for it.

Iiiiiiiii dunno. Have you PERSONALLY played the quality releases on iOS? No- 3DS doesn't wipe the floor with visuals because iOS can run Unreal engine 3; go have a look at infinity blade. 3DS can pull all the stops too, so graphics are a given these days. I love my iPhone 4 and seeing the appstore grow has been very exciting. Things from Infinity blade, Dead Space, NBA Jam, Plants Vs. zombies and much more have established a pretty solid platform. World of Goo on ipad.. they're becoming competitors and Nintendo has realized that.

To say they will never be on par is just being a fan boy. I know 3DS or ngp will have more & quality games-- but iOS has come a very, VERY long way. That and the iPhone in itself is very sleek and versatile, and so the installed base can enjoy good games without buying a dedicated console.. It's not designed for gaming but it can do it.

I'll have the best of both worlds come March 27th-- pre-ordered and just as excited as I was for the Wii (:

It kinda makes sense that this firmware update does not contain any blocks to flashcarts. It's most likely been in the works for a few months now, so that it could be made available upon release. Remember that you need 2-3 months lead time to get stuff from your factories to a store. So this was more of a release day firmware patch than anything else. They certainly have not had the time to analyse and test a new firmware for addressing the current flashcart issue. Firmware updates are expensive to recall so you really really need to test them carefully even for potentially 'minor' issues.

I suspect that the big 'May' update will contain some anti flashcart protection.

Here's a big conspiracy for you guys since many seem apt to indulge in such silliness. Nintendo purposely made the 3DS compatible with flashcarts. That way you would buy it thinking that you can play all your 3DS games. Then in May, BAM, all your flashcarts are blocked permanently. Now you're forced to go out and re-buy your DSi that you traded in to play your older games. Amusing no? Feel free to hash this out amongst yourselves.
If they do this than new buyers might not buy it knowing that it wouldn't run their flashcarts.
The DS scene is beginning to end, and it should end completely in the next 3 years.
What yields more profit over time,

Someone buying a 3DS and a DSi, but less people buy a 3DS, OR
Someone buying a 3DS and more people buying 3DSes.

Xperia play has a controls, random though. Anyway no 3DS/NGP is definitely better in games then the iphone.

Just because a team/company doesn't chose to used a engine on a device doesn't make it
inferior to the other.

Look like I can update safely.
