David over at 3DS Blog has confirmed that the 3DS does not automatically update. You can watch the video in the link, but here's the bottom line: the system connects automatically and notifies you when an update is available. You have to read and accept a user agreement (DUH) before installing it! Basically, all we have to worry about is Nintendo dangling something really good in our faces, or some really good games that will include updates. Not the biggest news ever, but it is good news nonetheless. We no longer have to worry about setting aside our systems and having them lock us out of our precious homebrew.
