It is pathetic and immoral. It doesn't mean it's not going to happen. Heck pirating is the main reason of the ban and it's pathetic and immoral too. It's not going to stop people from buying, ripping lfcs, returning the console and deploying to the masses. Anyways I'm just saying it's a possibility.

I don't think that fear is warranted. One, not EVERY 3DS/2DS owner has a hacked console that can even dump the LFCS, and even LESS that had modded consoles and got banned for playing pokemon, then you have EVEN LESS that would actually take the seed and resale or worse, returned a banned console. Hypothetically, that would account for maybe 2% of used 3DS on the market. I don't think it's a concern.

I still think it's a concern. But agree that it won't big. Buy 2nd Hand 2DS/3DS or pre-exploited from trustworthy sellers.
Then you should be safe. Although the chance is 2%, it's still possible. So better play safe than sorry.

I think most people selling systems would prefer to avoid having negative rep, for the sake of what? ( I actually don't know what a friend code seed would sell for, but I wouldn't imagine it wouldn't be much, and I think most people would prefer to dump their own to avoid exactly this issue)

Protip: If you buy secondhand, make sure it is unhacked but on a hackable firmware.

Not much people here is smart enough to unhack a console and sell as clean/retail. If anything they overprice a console for being hacked from the get go.

What i would advice is NOT to buy second hand from anyone with hacking knowledge (like anyone from here) unless it's a reputable user.
