Yes this is true. Most modern lithium ion batteries have protection circuits built in so you can't fully discharge the battery.

But for the first Charge you should give it at least 8 hours.(You can still play with it in it's docking station

It is still possible for a careless man to fully discharge a Lithium battery. Once you did you can't charge it since it needs protection circuit to be active and protection circuit needs power beforehand.

All lithium-ion rechargable batteries come partially charged, but never fully charged. Fully charged batteries damage the battery's chemistry, as does having the charge very low (or empty).

If you plug a battery into a new device (be it laptop, cell phone, or 3ds) if the system doesn't turn on immediately you should return it as it's guaranteed that the battery is damaged.

It's best to keep a lithium-ion at 75-99%
And 40-60% if you won't be using it for 4 months or more.
