This is simply a case of people not really paying attention, the LED 3D light will always be on as long as you are in a 3D capable game/app. Tales of the Abyss has anime FMVs that are not in 3D but the light is still on cause the game, overall, supports 3D. Same for pics, it would be unnecessary code and processing to have the 3D light shut for each instance where 3D was needed for a brief moment.

"unecessary code" ?? That's very stupid to think that. It's 5 lines of code at max. THEY should botter to do it since it is explained to work like this in the manual.

It's more than 5 lines, first the code would have to be made, then it would need a various checksums so as to not glitch. From there they would need a re-patchable code so they can add every game and at what points to shut off the light in each game or app at whatever point 3D becomes unavailable. It's a waste of time.

There are three instances where the 3d light turns off that I know of. They are:

1.When the game's developer decides to turn it off (ex. SSF IV's intro movie)
2.When the 3DS is playing a DS game.
3.When you disable it in Parental Controls.

It does not turn off when you turn the slider all the way down -- a popular misconception.
Also when using the internet browser.

Except while looking at a 3D picture.

Well it would depend a lot on how the system works overall. If it was supported in the SDK with a simple commando. It'd be two lines of code: set_3d_led_state(1); and set_3d_led_state(0); for example. (Or, if turning 3d off completely, set_3d_state(state); ). And that would be on the software, not the 3ds firmware. so it wouldn't need checksums not to glitch, and not need re-patchable code etc.

You do know about Region locked on your 3DS? You are stuck with playing Japanese game, not American's. No offence but why an idiot like you bought a Japanese 3DS on a trip without knowing about region locked? You have to take that 3DS back and get a American 3DS.
i think they got it to play japan release only games like monster hunter

or to play games early

if you never want to use 3D and don't want the light on, enable parental controls and set the restriction to not allow 3d images to be displayed. the 3D light will always be off once you do that.
Thx

Holy necropost, Batman!
Also: relevant information that didn't exist in 2011: HoriHD co-opts the doubled horizontal pixels to have a crisper 2D image. The 3D light will turn off when 3D is disabled in that case.
