My hypothesis is that Nintendo's detecting and flagging virtually every system, but only banning the subset that spends the most time online. My reasoning is that Nintendo considers a loss sale to simply mean a lack of revenue, but those games then going online to be a deficit as their server resources are consumed without the payment of a game to back it.
