If you check the threads on earlier posts,you will find a few people reporting that they have found people that got banned with a unmodded console.This anti ban detector Nintendo is implementing as a blacklist is clearly unstable since there have been people with cfw who haven't been hit yet.

On the gamefaqs 3ds board no one has reported getting banned yet. Most of the users there use OFW.
Yeah, nothing confirmed tho, so they are probably lying. If a lot of innocent people were actually getting banned the 3DS sub would be going crazy. It's only CFW users.
Nintendo wouldn't ban unless they know you did something.
Keyword, "confirmed" cases.
No one actually knows how legitimate they are, no one has solid proof those are legitimate.

There are also people who are here with cfw who haven't been banned yet.The funny thing is getting banned for no reason would get everyone to assume you have cfw anyway,even though its a possability that they didn't.

My brother's cousin's dog sitter's sister knows a guy who runs OFW and got banned.
That's how legitimate those "I know someone with OFW who got banned" responses are.
I haven't been banned yet, but my assumption is that they just haven't gotten to mine or my brother's 3DS yet.
Also, if someone legitimately was banned on OFW, they could prove it by recording a video of them holding START, and then confirming they have a ban with the error code everyone else is getting.

While in this case I'm not arguing the legality of it, as it is really a grey area, you are correct that it is in violation of terms of service.
And because of that violation, Nintendo/Sony/Microsoft/Your mothers cousins wifi expert can, and in this case deny you service because you broke the contract first.

Well the bans where global so anyone could of gotten hit.I wasn't sudjesting where they should go for help but that there was a report of ofw 3ds's getting banned here.It could possibly be a lie since there is no way to prove they don't have cfw but who knows
You do remember you can un-ban yourself so no reason to worry on the 3ds not sure on the switch though as i haven't modded my two with cfw only modded mine with a neat cooling feature but that's it. the other is still sealed with mario odyssey in the box.
