So they are getting the title ids from spotpass. Im glad I turned it off a long time ago. But I feel they can see more than what spotpass sends them. I wonder how they will feel when their servers are basically empty when they ban all cfw users though

I wouldn't say that, the people that don't hack can end up getting sent hacked mons. So, they are safe, with genning, I guarantee you it's a very small minority, those same people thus can also do save editing and such. The numbers are big in terms of GBATemp and boards that specialize in hacking, but in the grand scheme of things, we're just a minority.

Their ban system is likely automated, so the time you are playing things for probably doesn't matter
So, if a system access is already banned, it doesn't matter if we don't turn the console on at all right now, right? I mean, not turning it on won't help a thing for not getting banned since they'd probably already have the info server-side for banning the access server-side.

Yes, exactly. There was a report earlier in the thread of someone banned having the spotpass "send info" enabled and who didn't use the console for a month (although it was possible, according to them, that they left it in sleep mode for a while and thus it sent data via spotpass).

I honestly don't know. However, if it was the former, then we wouldn't see this discrepancy with spotpass data (if everyone actually sent the current titleid via the friend list, and they banned for it). I think turning that off stops sending the title id to the servers

If we are fairly sure they are banning based on titleids, would it be feasible to start rebuilding CIAs with titleids from shovelware? Then even if the titleid was still being sent to Nintendo, they would only think we were playing some crappy game, rather than something like FBI or hblauncher?

I know for a lot of people it may be too late, I haven't tried going online yet because until everything gets figured out I'm too scareds lol.

Like I said in the other thread, my systems had it enabled, but weren't banned due to not being online. They still aren't banned and I've since disabled the option.
My boyfriend's system on the other hand had it enabled all night as he was playing his 3DS and his system ended up banned.

Time to rescue his Pokémon from the bank again lol

It'll be hard for people who likes playing injected GBA (or other VC Console) games, since every injected CIA should be fixed to an existing Title ID.

Oh, man. That's hard. Whatever, I don't have a 3DS.

Just double checked to be sure, but for me the settings are off and have been off since...hell, probably early 8.x, before full-on CFW was even a thing for the majority of people. And I'm not banned (just re-added my wi-fi settings, checked via friends list, and re-removed the wi-fi settings to be sure). Here's hoping it stays that way till we figure out how to circumvent this whole thing.

I believe if you have 2 cias with the same title ids they will overwrite each other if you try to install it after installing the other. If that makes sense

Yep. Exactly that. We'll need to check how many considered shovel-ware games are on the eShop.

Although, if it's only for 5 or 10 homebrew apps, it shouldn't be that hard.

Anyway, this is sad, since they are mostly banning because of homebrew and not because of piracy (yes, I know some homebrew allow piracy, but not all).

So far...

Both settings turned off on 4 units.

3 units offline, 1 unit online for testing for ripples from the ban bot.

Currently not banned. Initially checked if I was banned 12 hours ago, have confirmed again no ban (yet)

I will update further as needed.

Edit: update

2 units offline, 2 units on. Both online units are not banned (yet).

@Aurora Wright Do you actually know if disabling the "show current playing title" also stops sending your current title, or just making other users not display it?
One way to find out would be to edit a title ID to valid software not currently on the system, toggle Wi-Fi on friend list and note what happens.

So ironically, if all this is correct, if you haven't been banned (and assuming you're not already on a list to be banned), if you've installed pirated CIAs before, you can uninstall all of your homebrew CIAs, and play pirated games online without fears of being banned?

Unless of course they've started actually verifying whether a eShop CIA has been purchased for use on a given console's id...

Pretty sure this is the cause.
I got 2 3DS that never had those options turned on and never created a NNID.
One Old3DS with A9LH and one New3DS with B9S.

Not banned and just tried some MK7 online to be sure (original cart) and I'm still unbanned.

I played last night, nothing wrong. I will check again tonight and get you updated.
My setup is:

N3DS
B9S + Luma 7.1 + Emunand 11.4 with linked NNID.

My emunand has only purchased content from eShop, including BadgeArcade and Pokemon games.
I know for sure I have all spot pass and sharing options enabled.

The only "hacked" stuff I have is an injected FBI to H&S (NoBanner), that a I use to make regular backup of save games.
The injected FBI uses the H&S titleID, so I'm sure my emunand looks like a OFW.

I also have unlinked sysnand, where I usually install VC games, but have spot pass disabled in this one.

Again, will check again in a few hours.

Banned. O3DS with B9S+Luma on 11.4. Spotpass was enabled. buuut i was using a public LFCS from last banwave so I don't think it really counts.

Interesting, I finally decided to brave going online and seeing if I was banned. I had all of the streetpass and friend list settings turned on previously (I have them turned them off now). I have used hblauncher_loader, FTPD, and CTR-HTTPWN recently, all online. No ban (at least so far.) BUT I lost my friend list a long time ago when I system transferred from my O3DS to my N3DS, so I have no friends. Could it be that by not having any friends, it never bothered to report my title id?

Either way, glad to not be banned. I'm turning my wifi back off, and leaving it that way until I uninstall all homebrew-related CIAs. I'm on 11.3 luckily, so soundhax is still an option for me.
