@Aurora Wright Do you actually know if disabling the "show current playing title" also stops sending your current title, or just making other users not display it?
I honestly don't know. However, if it was the former, then we wouldn't see this discrepancy with spotpass data (if everyone actually sent the current titleid via the friend list, and they banned for it). I think turning that off stops sending the title id to the servers

Yep I prefer to ban a $25 sd card instead of a $200 system. Congratulations you made a great choice!

Returning to the topic at hand, it will be interesting to see going forward if blocking those sites at the router level prevents these bans in the future. I have a couple of seeds to burn, so I can test this in the coming months.

Enabled, not banned.

Im only 11.2 b9s. Only use freeshop to download 2 updates.
Never really use my 3ds.

maybe it's anybody with a CFW in general... users are probably getting banned in waves I haven't got hit by a ban at all yet but I know it's coming soon enough

But the question is from a technical viewpoint "how do they know you have CFW?"

The system boots and works exactly as a stock system, so the only way they could is probably via getting installed Titles IDs, at least according to the info AuroraWright is gathering.

I just checked my JP 3DS, both EU+JP 3DS with A9LH are not banned. Both went online in the last month with spotpass enabled, but both dont have any titlekeys/cias except the ones required for 3ds.guide. So I guess I am lucky or nintendo just hasnt gotten to me yet.

A certain guide (and many other less reliable copycats) definitely are encouraging their followers to get profiled: don't most of their followers blindly install FBI2, Lumaupdater, and hblauncher-loader?

Even if titleids alone are not proof of what these titles are, having the same 3 unreleased ones appearing on multiple consoles...

Well, yes, that's the point, and probably the reason people gets banned.

Playing unreleased "Titles". That's the whole point of making this poll, I think.

Not exactly true, homebrew apps can do things that normal apps don't have permission to do, they could have added a check for these extra permissions in a system title.

Like I said in the other thread, my systems had it enabled, but weren't banned due to not being online. They still aren't banned and I've since disabled the option.
My boyfriend's system on the other hand had it enabled all night as he was playing his 3DS and his system ended up banned.

That said, there's probably at least one other factor to account for the remaining 14% of bans. Imo, it might be the "share currently played title" option in the friend list, or playing online with foreign games.

It was enabled for me at the time of banning, so I'm not discounting that as a possibility. But, is it possible that said option is just a luxury for the friends? They can see or not see what you're playing, but the setting never said Nintendo can't see. That being said, the titles I used weren't for long. NTR CFW for instance was 2 seconds, how long it takes for it to boot typically, but of course that doesn't mean they don't notice it. JKSV, 30 seconds, FTPD, up to 5 minutes, Pokemon Moon, at least 18 hours. These are all from the activity logs.

I don't know about this technical stuff so much, but I'm pretty sure that they can't check if the system can load unsigned stuff, thanks to the Luma patches. Anyway, that's IMO, so don't take it as a fact, but I can swear I read a good explanation somewhere before...

So they are getting the title ids from spotpass. Im glad I turned it off a long time ago. But I feel they can see more than what spotpass sends them. I wonder how they will feel when their servers are basically empty when they ban all cfw users though

Their ban system is likely automated, so the time you are playing things for probably doesn't matter. They probably have a blacklist or whitelist and since that feature sends the title id to the servers (which relay it to your friends) they can use that easily
