So, if I understand this right, the home menu will send data of all installed/used titles to Nintendo. Also this is disabled by turning the send system data setting off in spotpass settings?

Also, just randomly, is the quote in your signature form When Marnie Was There? I just watched part of it last night.

So, yea I got banned as well, I got Freeshop, and starded playing MHXX every night since 1 week so far, I believe Spotpass is enabled because I usually leave my 3DS on stand-by mode almost the whole day while im busy, and I usually get that Blue Led on the top glowing.

I should check out later if I really got it enabled tough.

Edit: Got Zelda: Oracle of Seasons as VC installed, I want to clarify, every CIA is FBI installed, only t hing I downloaded from Freeshop was a Classic VC Mario Bros game.

I have it disabled and I haven't been banned... also, I don't do on-line, so who knows? The only moments I turn on Wi-Fi connection is when downloading from FreeShop. And nothing else.

Turned on my system with the internet off (it was off from last time I played), turned off the setting and then connected to the internet. Banned. Last time I connected was a few weeks ago.

the data on this poll is really useless, not going to get much of a signal based on that 1 setting...
I'd recommend anyone that filled this poll out to fill out the form from this thread: https://gbatemp.net/threads/regarding-the-recent-3ds-banwave.471781/

They should also collect what was installed into system as part of CFW such as HBL, FBI, LumaUpdater, etc...

If the poller posts the data I could run some models on it using my company stat software (SAS) to see if a signal jumps out.

Luckily no ban on my N3DS Super Mario 3D Land edition with B9S and Luma 7.1 using SysNAND.

I will note that I don't have any illegitimate games or software (HBL, lumaupdater, etc..) and this one mainly uses SKY3DS for pirating. I kept this as stock as it comes, so if I need HBL I use ninjahax and I did not install Luma into SysNAND so I update it via sd card.

Haven't checked the 2DS yet, but that one does have freeShop titles and the bloatware from 3ds guide. Will check when I get back from business trip.

Just checked the setting on my N3DS and turned it off. It was on, and my console is not presently banned. I cast a null vote to simply view results, as I’m not sure how you would consider “I am not banned, and it was enabled until I read this thread.”

I am not banned and I have Spotpass and send info to Nintendo disabled but I have a few friends that has that options turned on and got banned.

PS: I have sysnand and emunand unlinked, sysnand 9.2 emunand (Luma) 11.4 with NNID and I don't use freeshop.
My friends have arm9loaderhax in 11.4 and they're banned. they both use freeshop.

Of the 122 people who indicated that they were banned on this poll, only 19 claim to have that setting off. That seems fairly significant to me.

Is there a possibility of having an update to CFW that automatically restricts sending of information regarding hacking/homebrew to Nintendo, preventing them from having any knowledge of you using homebrew/CFW on your system even with the wireless communication turned on?
