I don't think this is the last until Nintendo breaks the entire homebrew community. If they have 1.4 and shut down the homebrew launcher, consider that bad. As long as they don't do some absurd check for cfw, I think I'll be happy.

Incorrect. I've said this so many times it's not even funny. When you purchase a console you are paying for the privilege to use it according to the guidelines the company has set for it. This doesn't make you exempt from either the terms of service or end-user license agreement.

Um no, at least not in US. The US (and many other countries) has laws that prohibit circumventing copyright. Even purely userland homebrew is technically circumventing copyright as you are running unsigned code on a system that was designed to prohibit that, making it technically illegal in the US.
Just because you own the system does not mean you get to do what you want with it, especially if you have to agree to a EULA or TOS before being allowed to use it.

You own the hardware. You do not own the code, only the right to use the code as intended.

The code is proprietary and put behind a lock. You bought a locked box. Trying to break that box is illegal. It is legal to try and replicate that locked box (creating an emulator), but it is not legal to break that locked box...sort of. The legality over "jail-breaking" is somewhat tentative, for example.

You can argue over the merit of that thinking :P but that's how it stands as per international copyright law (as I understand it).

To be fair, Yakara is actually a nice guy, he fucked up big time, but he changed the uploaded files asap, even tho that doesn't change anything... Yakara has never claimed any of the developer's stuff of his own, he has always said that he just made things easyer to people that doesn't know how to read english or shit and want fast help, and also, yakara has ALWAYS said that this wouldn't be possible without you guys, the great devs out there making the 3DS modding scene possible, he says that in every single video i've seen, so, yes, he fucked up, but he've never claimed your code to be his own...

About Tcpixel, i feel also really bad, i enjoy the way he talks and everything he has done for a bunch of people, both of these yt'bers were gold for the community, imo.

Uh, wrong. He's taken the sources of popular homebrew and shoehorned his name into the credits and released it as his own.
