@tivu100 9.3-9.8 can't access the eShop. Smea has confirmed that the "freehax" it's working on 9.9, as the ninjhax and ALL >=9.3 userland exploit already known.
9.9 is available now from Nintendo servers. Tomorrow maybe it's 10.0 with a NinjHax 2.0 fix
or whatever, so the 9.9 is the last firmware surely exploitable to date.

And the NinjHax 2.0 is already released, so Nintendo had all this time from the release to work on a fix.

Still Smealum said something like he has "a plan", and he's also taking his time before making the announcement of the requirement. As I see: he isn't afraid of a firmware update or he would boldly give out suggestion rather than wait and make a fool of himself in case Nintendo may release a firmware update right before he releases his "then supposedly useless" announcement.

My point is everyone can speculate (I myself love the speculation game on other threads) & give their opinions all they want. However, it's wise not to make suggestion to others while the author/developer of the "hax" tells us to wait for his announcement when things are ready.

That's being said I may be totally wrong here and you may hit the jackpot. However, if it follows your script, nobody would reasonably blame me, because I don't make suggestion. Same goes for Smealum with his Twitter posts.

***Note: This part is a speculation game: perhaps in next few days, the "useful" 9.5 keys are leaked before Smealum free hax's requirement announcement, and possibility for kernel exploit, then CFW arrives SOON. People would react funnily to your suggestion, if then Smealum officially announces 9.9 is not necessary (knowing some people are more into CFW than just homebrew launcher).

"It's not necessary, but it's definitely 9.9 compatible" He confirmed right there that it works on 9.9, but he never specifically said to update, though I'm very curious as to what he's up to since it's "not necessary".

I think not necessary just means if you have the game downloaded you'll be fine, but if not you'll have to update. That just what i got out of it. Though I guess we'll know for sure pretty soon

But the guy was on 9.7 or 9.6 if Im not wrong and as far as I know those kind of patches dont work above 9.2.
I had downloaded eShop games before they implemented NNID as a requirement. After updating, but before building my NNID, I still could run the eShop games.

However, I have made a NNID since then, associating the preNNID purchases on the 3DS with my NNID.

So, it may be possible to update from 9.2 to 9.6 and keep preNNID purchases.

Just an educated guess.

And who knows, it could exploit the eShop app itself, using some obscure code in it to run HB.

Honestly, though, I just think it injects it into any appilication on your 3DS. PRW, PWM, HAS, etc..
