Hacking Does Microsoft still ban for failed CIV checks?

Hey guys, I know that this question may at first seem like it shouldn't warrant a thread but I can't seem to find an answer to this question that's more recent than 2011 or so.

Basically, with the awesome help of Sicklyboy I was able to get my disc drive flashed and it plays backups (XGD2 at least) just fine. However, I don't have an ihas drive but the drive I'm using IS compatible with Burnermax so I am able to burn XGD3 games just fine without errors in imgburn (using Verbs from Singapore MKM-003, recommended settings).

No matter what I do though the results in Nero Discspeed give me a result between 40-50% quality which obviously isn't great. I'm aware that it's most likely my burner's fault (I can't edit any settings in the lite-on tab in imgburn so I can't do everything the optimal way) and I haven't tried any of the games on my 360 at the risk of getting banned.

However, I was wondering if at this point would it even really matter? I know that people are going to tell me to just get the iHas but honestly I don't want to dish out the money and I still haven't decided if I even care enough about Xbox Live to care if I get banned or not. Though I optimally wouldn't want to.

Has MS done a ban wave in the recent past and do you believe that they will in the foreseeable future? Obviously we can't be certain but I'm more asking about your general thoughts. Obviously if I had the resources I would want to get the burner and burn the games correctly but that may not be an option for me. Thanks guys!
