i was wondering if anyone hit "later" for accepting the new user agreement [i did] and if that is in any way bad [as in a popup again at a later time, which will boot into sysnand or something while updating because i didn't agree]

Heh i wish i knew, i can tell you how i lost mine though.

I was switching sd card in 3ds for a bigger/faster one.
1. I've copied all the previous sd card data on my pc.
2. I've formated my new sd card inside my 3ds - i'm guessing that might have triggered something like nintendo deciding old sd is invalid and so is the data from it.
3. I've created new emunand partition in gateway menu
4. I've copied back all the backed up data from my pc to my new sd card.
5. I've updated emunand
6. I've realized i lost all my streetpass data.
7. Tried switching back to old card but my data was still lost..

aside from that:
Also some games like pokemon y keep saves inside the rom file so don't delete those roms rather keep them backed up. I've also made that mistake.
Oh and your data gets corrupted if you add new signature to a rom file, some games simply remove the previous save file without asking (harvest moon new begining) so it's also a good idea to back up your saves before playing around.

That's pretty much mine experience related to problems with illogical nintendo save data keeping.

That's also why i suggested using a tool to copy nand rather than format and create new one on 3ds.

It was, definitely, this step here...
I can't explain in fancy words but, once you format your SD Card something (encrypt key or something) changes and everything you have previously stops working (not sure about saves though and streetpasses).
Let's say your 3DS came with a pre-installed game (Mario Kart 7, for instance) and if you do the steps you mentioned, that game will never work in your 3DS again.
Well, if I'm talking nonsenses, please, correct me.

Cheers

You can re-download pre-installed games from the eShop.

That's because when your SD card is empty, the home menu will generate a new UUID for your SD card. This is the first folder with hex looking characters in your Nintendo 3DS folder.
If you just copy your old one over again, it should work I think... Well either that or the UUID is coupled with your NAND.

I guess it's coupled.
Isn't it?

Right!
But since the UUID changed, simply copying over the backed up SD card files will not work, which is the case the other user mentioned.
But you're right though. Redownloading should make your old games start working again.

what will happen when i try to play online SSB on gateway?

Whats the worst that can happen? absolute worst!
well according to the MPAA and other such organization's it may indeed bring civilization to its knee's everyone will be poor....it will even trigger the worldwide spread of ebola, earthquakes tornado's, volcanoes will all simultaneously hit around the world and the earth will be torn into 1 million pieces.....according to anyone with half a brain.....nothing at all really in the grand scheme of things

lol not answers i expected x)

now seriously!

what will happen to 3ds or gateway..i mean is it safe? whats the worst that can happen by playing online?
nothing....it will play, you will play online, you might loose a few matches or something....maybe in a fit of anger throw your console and smash your tv and 3ds.......try control your anger and nothing really should go wrong

so far nobody has had any issues except the odd D/C which happens if when playing on a retail cart and it kicks you out of emunand when you exit the game, anything else on the matter would be pointless speculation of things that might happen in future, but theres been no bans or anything i presume thats what your fishing around for someone to say
