freeShop has VC games as well, including Gold/Silver. It's not just 3DS games.

RETAIL Pokemon Silver-Gold for 3ds?

Perhaps a bad example, there are games that are retail-only that you need the cartridge to play (legally)
but Pokemon Silver/Gold sets a new standard by retailing without any cart and only a boxed download code...
