Nintendo Wins Copyright Case Against Canadian Flashcart Retailers

gocyber.png

Canadian Tempers beware, it looks flashcarts sold from your country are going to be a lot harder to find. Nintendo has just won a recent copyright right case against Go Cyber Shopping Ltd, a Flashcart retailer that's based in Canada.

Canadian federal court ordered Go Cyber Shopping Ltd. to pay Nintendo $12.76 million (that’s in Canadian dollars; it’s $9.51 million American) for selling devices that circumvent copyright protection on Nintendo’s 3DS handheld. These products, typically known as “flashcarts” in the modding scene, typically sell for $20 to $60, and they include items like Sky3DS and Gateway 3DS. While players can use them to load homebrew software, people typically use something like a Gateway to load in 3DS games that they’ve illegally pirated from the internet. Selling flashcarts is also against U.S. regulations.

So what does this mean, exactly? Flashcart retailers from Canada will likely shut down, meaning finding flashcarts that ship from the Canadian region is going to be a lot more difficult, if possible at all.

Thanks @Qtis for the tip!

Does this only affect the sale of 3DS flashcarts, or all kinds of game copiers or mod-chips for sale in Canada?
If it's only the former it's a bit of a shallow victory, seeing as Gateway and Sky3DS have stopped being relevant for a long time now.

Can't say I've ever heard of that company before. I think there are too many different ways for people to get flashcarts for Nintendo to make a difference in this country.

if they really want to do a real action against 3ds piracy, they'll need to attack free cfw.
Because flashcard, lol

Yeah but then Nintendo would actually have to try and give effort. Easier just to get their legal department to do stuff instead of the programmers :P

I've always typically ordered from overseas, usually in China somewhere. That's where I get my spare parts and flashcarts. Canada always seemed a little too close to home to be buying equipment from. Nonetheless, not going to blame Nintendo. They're protecting their products and are well within their rights to do so. All of us here can't really complain. These things happen.

That's true, but there's a difference between asking a company to stop supporting Flash Carts for their devices, and suing them into an oblivion and taking down another place for people to buy parts for consoles and replacements etc.

Yup. Checked Modchip central, they have completely removed flashcarts from their product listing.
Ironic, for a site called modchip central, to stop selling flashcarts. Anyway, no one needs them on 3DS now, obviously. When the inevitable Switch flashcart comes out, I guess importing from China will be the only way to go.

Exactly what happened to a lot of sellers here, so now you have sites like "R4iTalia" peddling iPhone touch screen replacements :D
And of course there still are businesses (more or less legally registered) that sell flashcards - although 99% of the time they only have r4isdhc.com dual core or other junk
