Nothing you can do or apple can do. iCloud locks are extremely hard to bypass, and they're encrypted in the iBoot partition, which is locked away.
You would need a iBoot exploit to bypass it, and there are none for 64 bit devices :/
I would say instead of smashing it, you use it for parts, or maybe (I don't know if it's possible) swap the flash memory out?
I don't know where to buy one but that's speculation of how to restore that iPhone.
Although, the iCloud lock could also be a server thing, which is near impossible to bypass :/
Where did you get the phone? A store will replace it and ebay will refund your money. If you found an iphone on the street and you can't activate it, you could try and take it to a police station where they'll hold onto it and wait for the owner to come find it.
