(Title). I know that in the Activity Log, they can see Alex Rider, and that it may be possible to determine that this is a flash cart, but can they tell if some one was using the DSTwo to play DS game xyz?

So they cannot determine that any roms were played on the flash cart. Also, does anyone else have the problem with their DSTwo that the case on it can be kind of loose? It stays together, but I have to keep popping one corner back together (the bottom right corner, if reading the label).

If you play a game with wifi, nintendo can see that you are playing alex rider on 3ds as your most recent game and see that you were on X game online with that same console at that time.

However they can't do anything about it.

Do you mean if I was playing rom xyz in an online mode they could see that and notice that it was different from Alex Rider?

They can probably see what game you were playing at what time on your 3ds if its connected to wifi though. It doesn't really bother me. Not like 2 guys in suits will show up to my house and demand all my electronics....right?

Nintendo probably sees each player with Alex Rider in their gameplay log as a flashcart user (Except the ONE person who actually plays Alex Rider the game), but there's nothing they can do.

They should have something that blocks People from Going online with any other game while playing a different game maybe that would fix the problem lol

Alright, I'm kinda confused. If I were using a rom from a flashcart, Nintendo would not be able to determine what specific rom I was using, even if my 3DS was connected to wifi, unless I was using a wifi mode on the rom?

idk what in the world everyone is talking about.
Nintendo cannot see you playing a ds game when your online. The only time they could EVER see you were playing a DS game, is if you sent the 3DS to nintendo and they checked your activity log. DS games do not show up on your online status, regardless if you play them online or not.
Havent you ever noticed that you never see anyone with a DS title as their favorite title, or seen them playing a DS game on online status?

Hate to double post, but your being a tad misled. as I stated above, DS games do not show up when you play them online or in wifi mode.
Regardless if its a flashcard or not.

Their Activity Log server's would show someone under your Username and Console ID Playing Alex Rider
Their DS Wi-Fi Server's would show someone under your Username and Console ID Playing XXX Rom

The most they could do is Ban You from the Wi-Fi Server's or possibly force a System Update for your console which render's The Flashcart Unusable (eg: Perhaps Brick the Flashcart?)

The activity log server only picks up on 3DS games. Ds games on 3DS run in DS mode, therefore it wouldnt show up even if he played on wifi.
However they could block him from DS wifi if they bothered to check it, but thatd probably only be for Pokemon games.

So nothing ever sees the specific roms as they are disguised as Alex Rider? There is no way to determine what specific roms were played?

DS Games that have been Played show up under the Activity Log and what time you played them....

Nintendo can see what games your Playing on Wi-Fi by simply looking at the users connected to the specific XXX Rom's wi-fi Servers

but as you can see, the wifi servers are seperate. 3DS online games run on nintendo network.
DS games run on a regular wifi server.
Which means they are checking Nintendo networks servers alot more then they are their old Nintendo Wifi connection servers. With as much pokemon I played on my r4, im pretty sure its safe to say they dont give a crap, or probably dont even see or check the old wifi servers.

So nothing ever sees the specific roms as they are disguised as Alex Rider? There is no way to determine what specific roms were played?

Yes they cannot tell. Unless they checked their old servers. Which is HIGHLY unlikely
